REGISTERING EMPLOYEES UNDER LICENSE LAW
********************
Ken
On the NYS Alarm web site under frequently asked questions it states:
Question:  Will I be notified when my employee has qualified for employment?
Answer:  Yes. Beginning June 11, 2015, Alarm Installers will receive a letter when their employees have submitted a “Business of Installing, Servicing or Maintaining Security or Fire Alarm Systems Employee’s Statement” and have qualified for employment.
We do both alarms and fire sprinkler systems.  Can we hire someone to do sprinkler related work and then later, if they want to do alarm related work, file their application with NYS DoS?  Or, do all employees need approval?
Thank you,
Jeff

NY's Division of Licensing Services notified the employer if the recently hired employee is not eligible for employment.  Now it appears the agency will respond to every applicant.  The registration process is for alarm work, not sprinkler work.  If sprinkler employees need to be registered or licensed then you need to follow that procedure.
I want to comment on licensing laws that require employees to be registered, certified or licensed in order to engage in the operation of the licensed business, in our case, the alarm industry.  The purpose of these rules that require employers to register recently hired employees [in NY it's within 24 hours of hire] is usually to

  • ensure competency
  • screen felons or others deemed unsuitable for the industry
  • enable the licensing agency to notify the employer if the employee later becomes ineligible for employment in the industry
  • collect fees

You should find out the licensing requirements for your state and strictly comply.  That will avoid issues with the licensing agency and potential issues with your subscribers.  Our licensing department can assist if you need advice.  Contact Nicoletta Lakatos,Esq at NLakatos@KirschenbaumEsq.com or 516 747 6700 x 311 or contact me directly.

What I did was request the homeowner meet me at the police station and let him log into his account. I was there only as a technical support to help them guide them.
