more on insurance

Ken,
Most policies written for the alarm industry are Commercial General Liability with an Errors & Omissions Endorsement and they are written on an Occurrence Form.  Just wanted you and your readers to know that.

Thanks for pointing that out.  General Liability with Error and Omission insurance is written as occurence policy [attorney and medical doctor malpractice policies are claims made usually].  With Occurence policy the carrier that has insurance in place as of the date of the occurence is the carrier that should defend you.  Careful with notice of claim requirements.  Failure to promptly report a claim can result in denial of coverage.

insurance for fire suppression

Ken,
In reading the daily newsletter I see an obvious lean to alarm companies using SARRG for GL and E&O. However I have been informed that they can’t offer coverage to alarm companies who also perform fire suppression (fire sprinkler, fire extinguisher, etc.) when that portion of the work is more than 25% of the company’s gross income. What are we to do, or who to consider using,  as a fire protection company when we are roughly 50/50 between alarm work and fire suppression? Do you have any suggestions? Currently we use one of the companies on your “black” list, and have for 10+ years. We are claim free, and haven’t had any negative issues with our carriers or agents during this time. However, someday, I’m sure the inevitable will happen and we will be dealing with a claim. I would like to have a company that supports us and is on our side when the trouble comes knocking.

I reached out to Alice Giacalone and she advises that Scottsdale Insurance covers fire suppression, and of course the alarm E&O.

Ken
While teaching the approved courses for the NYS License (see NYSESA in Alarm Exchange under training), I try to explain to students the concept of the three legged stool as a business model..... the first leg is a proper business entity, such as a corporation or a LLC, but never a DBA, which will come back to burn you.   Second leg of the stool is the need for industry recognized standard contracts (KK), which have all the protective clauses needed and have been time tested in courts..... and the last of the three legs of the stool..... insurance (I recommend SARRG) because, when (not if, but when) you are litigated against, you will need someone to write the check to KK to defend you.  If you remove one of the legs from this stool, you will fall and land on ...... oh well, we all know where.   That is my "stool sample" for today.
BTW... your daily blog should be recommended reading for all those entering our industry for the first time, as well a the "old timers".

Ken -
Russell H wrote - "No contract is involved at this time. When I go back I will have him sign one."
When will your readers get the damn message -
No Contract - No Job - No Work
Russell H had the supreme advantage before the work started to get anything, there was no Certificate of Occupancy to open the business UNTIL the fire alarm was finished and inspected.  If Russell had a contract, he could have demanded payment and walked into any Court and gotten paid, rather if the end-user business fails and they resort to arson as an exit Russell H will be in Court defending a claim that the system did not work.  Unbelievable,

This advise was in connection with alarm co's idea to bring police to help remove installed fire alarm system that sub's didn't pay for.
