    Does this also apply in Massachusetts to have both H&W sign? I can think of many occasions where we had no idea the person signing the agreement had a spouse.

    The issues involving providing security to residential consumers are pretty much consistent all over the US.  We know that there are more people living in a house than are required to sign the security agreement.  The party seeking a security system may not disclose his or her relationship to the premises.  He may be living there, on his own or with other adults and minors; he may own the property, intend to live there, rent, or leave it vacant, you simply may not know.  One line of thinking is that ignorance is bliss; if you don't know then how could you be responsible.  Should you ask?  Will the response make a difference?
    It's common that others are living in the premises in addition to the one who signed the contract.  I had a case where the wife claimed she lost her jewelry in a burglary and she never signed any alarm agreement.  She was right, but her husband had signed the Residential All in One.  I immediately demanded indemnity from the husband; the subrogation carrier's counsel had a brain freeze.  The case ended with complete discontinuance shortly thereafter.  
    Others in the house who decide to look to the alarm company for a loss are likely to claim rights under the alarm contract.  That's fine because claiming rights comes with all the contract provisions; another dead end for the case.  But more knowledgeable attorneys representing parties against alarm companies try claiming that their theory of liability is not based on the contract but on tort theories.  It complicates the defense, but if handled properly will also end in no liability for the alarm company; but not quite as easily as it would be with a Kirschenbaum Contract™.
    It's a good idea to know your customer.  It not only will help you design the security but it will guide you on how to prepare the contract and who will be asked to sign the contract.  But you can allow only a husband or only a wife to sign the contract, but that contract should not show husband and wife as the customer; if it does then you should get both to sign or get one of them to sign as agent for the other; two listed customers and two signatures.
