    We recently sold a CCTV system with audio to a day care in Alabama.  One of the board members suggested that we not include audio as there had been a recent FCC ruling that could be detrimental to the day care recording audio.  I thought that if audio were being recorded a sign had to be posted for awareness and then it was legal.  Could you give us your thoughts on this please?

    2018, another year, but the same answer.  I am not aware of any sign requirement, and I am not aware that signs would create or constitute consent to audio recording.  Audio laws can be found on our website under Alarm Law issues:  https://www.kirschenbaumesq.com/page/alarm-law-issues
    The Day Care could easily deal with the audio issue by having all students [their parents] and teachers sign consent forms.  That is what you should suggest. 
    The board member may be correct that the audio could be detrimental to the day care, and could just as easily wonder what benefit the recordings would be.  Video should be sufficient.  Lot of data to keep track of.

    A few months ago we purchased a handbook from your company. We would like to purchase a monitoring contract also. Would you suggest the 3 way central station monitoring agreement? We use a wholesale monitoring company and it provided us with a monitoring agreement.
    We would like to include information regarding the charges for runaway signals and signal overage charges. These items are difficult to control without the cooperation of the customer. We would like them to know that they will be ultimately responsible for those charges. One of the old monitoring agreements provided by the central station contained that information but no longer includes it.

    First, the handbook is useful, but you should have the Employment Agreement and be sure that all employees have signed an employment agreement.
    Second, a dealer should never use an end user monitoring contract provided by the central station.  You need your own monitoring contract.  It's very unlikely that the monitoring contract is all you need.  In almost every instance you are better off with the All in One Agreement because it covers the sale, installation, repair service, inspection and monitoring.  It covers all types of security systems.  The Residential All in One covers fire.  The Commercial All in One does not cover fire, only security.  For commercial fire, use the Fire All in One.  If you do fire protection and suppression, then use the Fire Protection All in One.  If you order all 4 All in One agreements during the Contract Sale going on now through January 10 2018 you will save $1000, so don't miss this opportunity.  
    The 3-Way Central Station Monitoring Agreement is not an agreement you would buy; it's for the central station to buy.  This is essentially a monitoring agreement designed to protect the central station, first, and then extend some protection to the dealer.  This is a form that central stations give to their dealers who either don't use their own contracts or use non-standard form contracts that do not provide sufficient protection.  You don't need the 3-Way if you are using the Standard All in One agreement.  
    The Residential and the Commercial All in One cover run-a-way, false and excessive alarms, as well of most other issues you should be concerned with.  Get the All in One forms.
