CHECKLIST ON INSTALLATION
**********************
Ken,
One idea that has bothered me is that there is no form (or at lest one I am aware of) that is used to check off various points that show we have explained system operation to the customer. I remember buying a car several years ago and the salesman had a form he checked off such items as: 1. Explained overdrive gear when to use and not use 2. Heating air and air conditioning how to use 3. Spare tire and instructions how to change, etc, etc..  I had to initial each one he went over with me.
Do you have a form that we can have customers sign off on that says that the various system operations have been explained?
    Thanks,
Ron Baumann

Good point.  I've updated the Disclaimer Notice to include a provision that the system was explained.  The Disclaimer Notice had only that additional equipment and services are available, and declined.  I did not include a check list because the list of equipment would be endless.  You can of course create the checklist or have the subscriber sign off on the Schedule of Equipment and Services [or your proposal] that all systems have been explained, etc.

NEED FOR QUALIFIER AGREEMENT

Ken
I will be using my  License to qualify for the company where I am currently employed.  I would like to know how much exposure I have with and without the qualifier agreement in place?
Thank you,
CS

I have repeatedly warned both license holders and companies that they need to document their relationship unless the license holder is the owner of the alarm company.  There are essentially 3 relationships I envision between alarm company and license holder

  • owner is license holder
  • regular employee is license holder
  • outside person is license holder

Our Standard Qualifier Agreement protects both the company and the license holder.  The single most important aspect of the Qualifier Agreement is that it should withstand scrutiny by the licensing authority regarding the genuiness of the relationship.  The Qualifier Agreement will spell out the duties of license holder and alarm company.  Why is this so important?  Because the license holder doesn't want to lose the license by suspension or revocation, and the company doesn't want to lose the license and also be told not the bother filing for a license with another license holder because the company is also suspended or blackballed.  That's the end of the business in that state.  Serious consequence?  You bet.  Licensing agencies do not take kindly to bogus license holders peddling or "availing" their license.  It needs to be a real relationship, and that starts with a real Qualifier Agreement.
The agreement will address term, payment, responsibilities and termination.  The cost is $1500.00.  Call our licensing department to get this agreement.  We recommend that it be requested and paid for by the alarm company, though we accept payment from the license holder.  Contact head of our licensing department, Jennifer Kirschenbaum, Esq. at 516 747 6700 x 312 or Jennifer@KirschenbaumEsq.com or our Contract Administrator Eileen Wagda at 516 747 6700 312 or EWagda@KirschenbaumEsq.com
