Costco is being sued for this same thing. I’m thinking if we send a reminder at the bottom of their invoice they would receive their reminder every month. i.e.: “Your annual automatic monitoring renewal is January 4th” They most likely don’t read the whole thing anyway. Your thoughts? Mike ******************* can auto-renewal notice be on invoice ******************* The best answer is no, the auto-renewal cannot be on the invoice [unless the statute says it can and I don't think it does]; not all the invoices and not the one invoice that needs to be sent within a statutory window, not too soon and not too late for the subscriber to exercise the right to cancel. This is a good example of trying to come up with something that you think is common sense and helpful [even if you cynically think most people won't read it - and right you are]. But maybe the legislatures and judges also thought customers wouldn't read it on their invoices, because then I've seen it addressed a separate notice is required. You shouldn't even include anything else with the notice. And this is a good example of how and why you shouldn't and can't use your [bright] ideas as a solution to something the law requires you to do. When the law addresses an issue with detail you need to follow it, not come up with something different, even if you think it better. Good example is First Class Mail served by US Post Office. Simple enough. You do not comply with sending it Certified Mail. Serve by email; you don't comply by sending it by mail or even hand delivery, unless that is an option. Just follow the law as long as it contains the details you need to follow.
