Both names are on the agreement but the husband was the one that physically signed the agreement. Do we have a legal obligation to keep doing what the other one says or is there a way to navigate this legally we should be taking? Thanks, Joe ************************ Response *********************** We have had many articles on how to handle divorcing customers, or business partners feuding. This question is easier because only the husband signed the contract. The wife has no contractual rights and should be told that. Next time, next alarm company. maybe she won't be so cavalier not to sign the alarm contract. But her name is on it. Why not put some famous billionaire's name on it if it makes you feel more secure; that billionaire won't be responsible for the contract either, though I doubt you hear from him, or her, asking you to change codes. You should not be in the middle of a divorce or business battle. First look to your contract for who signed it. Next consider who historically has been dealing with you. If you depart from the contract signer however you should be relying on a court order or at very least an attorney's letter. The better course may be to do nothing, absent a court order which is unlikely. I haven't seen an alarm company actually dragged into court as a non-party and ordered to do anything. That however, would be the formal way to get it done. Technically you could also seek court intervention, commencing an action seeking declaratory relief, a court order directing your rights under the contract since there is a dispute, a justiciable dispute, regarding the contract.
