They have quickly realized being on fire watch is much more expensive than paying our paltry amount for alarm service (they have over 100 zones of fire alarm devices!). So, the legal question is, since we terminated service, do I need to get a new agreement or just re-instate under the original agreement and have them sign a service ticket with it stating the original agreement is now back in place? The agreement we have is silent on this matter. Respectfully, Joseph (Joe) Pfefer, President & Founder Jade Alarm Co. ************************** Response ************************** You have to get new contract or written agreement reinstating the old agreement, attaching the old agreement to the reinstatement agreement. You should not just resume services once you have terminated without written agreement. New agreement is of course best since it will re-start the initial term. I don’t know if this customer is on a K&K Fire All in One, which would be the proper contract. It is silent on reinstatement. It’s clear on termination; contract and all services are over. Resurrecting the dead is best left for others. Your contract with this customer is over. By the way, with fire alarms one of the most potent moves you can make to bring a customer back on board is to follow through with your “threat” that you will have to notify the fire marshal of the pending termination of the fire alarm monitoring. Before you reinstate with a customer be sure to find out if the FD requires some reinstatement fee. Getting this customer to pay and reinstate is great job.
