I question if one can lend their license to another in New York legally?  How about anywhere else?

Response

It should come as no surprise that license laws have become more complex and demanding, and enforcement by the AHJ [usually the state] more common, in fact persistent and thorough.  The state [and sometimes municipalities] take the alarm license seriously.  Some states have separate licenses for security and fire, and low voltage.        Running afoul of these license requires run the gamut of civil fines, revocation and permanent punishment, to criminal prosecution.  Bottom line, don’t fool with the license requirement.
As the question is framed, can you lend your license to another, the easy and quick answer is no, you can’t.
Licenses are issued to individuals who have the criteria required by the license, and that criteria is different everywhere.  Once the person and qualify that person can request that the license be issued to permit a legal entity to be licensed.  The legal entity’s license is of course only as good as the license holder’s continued qualification to hold the license.
Legal entities [corporations, LLC] can employ persons who have the qualifications to hold the license.  The duties the license holder must fulfill and the obligations of the business are specified in the license law and accompanying regulations.  The relationship of license holder and company must comply with the strict requirements of the licensing law, though interpretation and enforcement can be different in different jurisdictions.  Suffice it to say that you should strive to comply in all respects.
K&K recommends a Qualifier Agreement for each license jurisdiction and offers this form agreement as a Standard Form Agreement, and customizes each agreement according to jurisdiction and arrangement between License Holder and company.  K&K’s License Coordinator Eileen Wagda 516 747 6700 x 312 or EWagda@Kirschenbaumesq.com, will also assist in placing a license holder with a company and maintains a list; there are also posts on The Alarm Exchange for those looking for a license holder and license holders looking for a position.  Confusing this service with “lending” a license is a mistake; don’t do it.  The Qualifier Agreement will lay out the relationship and that’s what it should be.
