If we do not purchase new contracts, can we continue to use the 2022 contracts with them being valid? Jessica *************************** Response *************************** Contracts from 2022 are now 3 years old and should be updated. Though enforceable when you bought them over time they become outdated and may no longer be enforceable for new contracts or on renewal terms. You have to understand that contracts go through updates throughout the year, perhaps up to 10 times, so a contract from 2022 has likely had 20 or more changes. While many of these changes are mere tweaks, some are more critical. Also, you may be in a state where a change was required. As I write this article the FTC rule on automatic renewal went into effect January 1, 2025, requiring a change in all contracts. While some states may have had similar rules already so that you contract more or less complied with the new FTC requirements, your contract will not have the precise wording FTC is looking for. How this will affect the contract renewal enforcement remains to be seem; and of course if Trump rescinds FTC rules or the FTC altogether, remains to be seen. Best practices and rule of thumb, update your contracts every two years unless there are required changes necessitating immediate updates. The Concierge Program has proven to be wildly popular.
