No more confusion about discounts; it's simple: ******************************* Can you use word Protection in your name ******************************* Ken Once again, thank you for the good advice. Back in 2011(?) we had you form a new corporation for us, it uses the word Protection as part of the name, any issue? FDNY has a division, "Fire Prevention", under that division is the Fire Alarm Inspection Unit (used to be electrical unit) and Suppression Systems (a/k/a sprinkler unit) unit, there are many other units as well. I have always felt the fire alarm and suppression systems units, as well as others, should be under some other division, in my opinion, they are not "prevention" systems, they do not prevent fires. In the sprinkler world since I started in the late 60's, terminology has changed and better defined. It was thought sprinklers would extinguish a fire (they usually do), now we have Control Mode Density Area, Control Mode Specific Area, Early Suppression Fast Response, Quick Response, Standard Response, and a few other terms to better define what the system is designed to do. Unfortunately we use these terms and many times the people we are speaking with do not realize the differences even when we explain them, they forget, they may hear but not retain, not truly concerned (I just want to meet code, just do what will get me my C of O). Systems are based on what the hazard and commodity, which sometimes changes, those changes may negate the design basis of the system. Jeff ********************************* Response ********************************* You can use the word Protection in your name, especially if you also use Kirschenbaum Contracts. I say it that way because no matter your company name the contract you have the customer sign is unmistakably clear that you are not in the “protection” business. Of course fire “protection” business is quite different than fire alarm business; fire protection business comes much closer to providing protection than alarms when you make the distinction between protection – prevention – detection. The word Protection can be interpreted differently and as long as that interpretation doesn’t cross the line to prevention you are going to be safe from a liability perspective. The contract is important; just be careful not to negate its effectiveness by too much puffery in your promotional material. ************************ STANDARD FORMS Alarm / Security / Fire and related Agreements click here: www.alarmcontracts.com *************************** CONCIERGE LAWYER SERVICE PROGRAM FOR THE ALARM INDUSTRY - You can check out the program and sign up here: https://www.kirschenbaumesq.com/page/concierge or contact our Program Coordinator Stacy Spector, Esq at 516 747 6700 x 304. *********************** ALARM ARTICLES: You can always read our Articles on our website at ww.kirschenbaumesq.com/page/alarm-articles updated daily ******************** THE ALARM EXCHANGE - the alarm industries leading classified and business exchange - updated daily ************************* Wondering how much your alarm company is worth?
