Question - can you terminate monitoring

Hi Ken,
My question is this: When are we legally allowed to terminate central station monitoring for non-paying customers?
Let's say we have a non-paying customer (delinquent 6+ months) whom we call and send statements to with no response. If we still don't hear from them we send a certified letter stating that unless we receive their past due balance by such and such a date that their CSM will be terminated on said date. If they still don't pay and they DON'T have a CSM contract then we terminate service and cancel the account.
But how should we handle customers who DO have a contract? Given the same scenario, after getting no response to the certified letter we then proceed to small claims court and sue them for the remainder of their contract. If we win the lawsuit and they pay us the settlement, can we legally shut off their CS service? Are we obligated to keep them on line until the contract expires since they paid for it?
And what about settlements where they don't pay up? How long do we wait until it's clear they're not paying us until we can terminate their service?
Right now I have 5 customers who are in this situation, so I will await your response to see how I should proceed. Thank you very much for your help.

You're confused because you either didn't read your contract, you don't have the Standard Monitoring Contract [or the All in One that includes monitoring], or you don't believe the contract means what it says or that it's enforceable.
If the subscriber fails to make payment required by the contract then the subscriber is in default. The contract provides what rights you then have, and they are definite and decisive. Don't confuse them by coming up with some other ideas. Under the contract you can stop monitoring, accelerate the balance of the contract and sue for that balance, less 20% plus your legal fees. Once you terminate monitoring and sue for the balance of the contract you are not required to continue monitoring. When you terminate monitoring, if you decide to give notice, make sure you give a definite date when monitoring will terminate and don't give any option to continue the service.

I want to mention one other matter. The Standard Form Contracts never call for certified mail. You should always read your contract carefully to see how notice is required to be given - then follow that method - don't make it better or worse. If the contract says mail or regular mail then certified mail is not proper notice. If it doesn't get delivered you wasted your time. If it's contested in court you could lose.

I have a question regarding original signed contracts vs. scanned/faxed copies. As a company we have always required the original signed paperwork before performing any work. We usually will order the equipment and schedule the work based off of a faxed or scanned signed copy. However, each year it gets harder and harder to get the original signed paperwork from our very busy customers.
Is this a policy that we can or should change? Is there any advantage or reason to require the original signed paperwork over a scanned or faxed copy?
