We have been fortunate to sign several national chain accounts for fire, security and surveillance and want to make confirm our contract is valid in those states. Renee T ********************** Response *********************** K&K contracts are designed for single state use. When using out of state you should check with us to see if the contract conforms to that state's specific issues. Only our nationwide forms are designed for nationwide use. The commercial contracts often can be used across state lines, and which contract you need depends on a few factors. You should join the Concierge Program and take advantage of our legal services. https://www.kirschenbaumesq.com/page/concierge The Concierge Program allows you a free half hour each month for contract review, negotiation and advice. That alone is worth the cost of the Program. There are so many scenarios when it comes to contract execution it’s not feasible to cover it in an article. For example, will your service be just monitoring which you will subcontract to a central station? Will you be contracting to install, inspect or service commercial fire alarm systems? Will you subcontract that work out? Where will your contract be signed? Where the national customer’s main or satellite office you are dealing with located? Will you be installing and servicing, administering, access control? What about cameras? Will you subcontract that work out? To avoid any suspense, and sorry to disappoint you … If you contract to perform a service you need to be licensed, either to perform the service or as a General Contractor authorized to engage subcontractors in that state or city. Most of you are not General Contractors, though that might be easier to get than an alarm license. K&K can assist you to find a person who is qualified to hold the license for your company and K&K provides the Qualifier Agreement which will lay out the relationship between your company and the license holder. An owner doesn’t need the Qualifier Agreement, but if anyone other than the owner holds the license I strongly suggest you have a K&K Standard Qualifier Agreement in place. Note that these license holders generally get paid monthly for holding the license and the monthly fees can range from $500 to over $2000, so obviously the work in the jurisdiction needs to make sense for you to incur the on-going expense. K&K does NOT charge to assist you in finding a qualifier, but does require the purchase of the Qualifier Agreement form before undertaking the search process.
