Avoid small claims court
***************************
          Those of you using the K&K Standard Form Agreements know, or should know, that K&K’s collection and litigation department will support you when we can utilize the arbitration provision in the contract.  Some of you are convinced that Small Claims Court is the way to go.  The following case fits within my thoughts about Small Claims Court.
          The title to this article should have read: Small Claims how to gamble and waste time and money.
          The plaintiff in this case brought a coat to a dry cleaner who lost the coat.  The dry cleaner had a sign in the store and on the back of the dry cleaning ticket limiting its liability to $49.  Not willing to accept that amount the Plaintiff sued in small claims court.  There was a trial in which the trial judge refused to enforce the limitation of liability because there was no proof the Plaintiff was aware of it, and after trial, awarded Plaintiff $1000.  There is no mention whether the parties were forced to appear in court more than once or how long they waited for the trial or how long it took.
          Not satisfied with the decision, the dry cleaner appealed to a higher court.  While no “printed appeal record” was required the parties did have to present legal briefs.  They needed lawyers.  The appellate court found that the trial judge in Small Claims made the award without hearing any testimony regarding the style and condition of the coat.  Therefore the appellate court vacated the decision as to damages [not as to liability and non-enforcement of the limitation of liability clause] and ordered a new trial on damages only.  The new trial is going to takes hours to prepare for and attend in court. 
          I think there is a “matter of principle” and poor business practices.  The dry cleaner fits into the latter category in my opinion.  And so would you if you were battling a claim like this and investing the time and money this case had to have taken.
          Small Claims is a crap shoot because the Small Claims Judge is governed by a nebulous concept of “substantial justice”.  Here the appellate court found that “substantial justice” required a remand back to the trial court for a damage trial.
          As a person operating a business you need to keep your eye on the ball, on the goal post, on the bottom line.  Your job is business growth, prosperity, ease of operations.  If you want to spend your time playing lawyer, or paying for lawyers, on non-sense like this, then, I respectfully submit, your eye is not focused. 
          The arbitration clause in the Standard Form Agreements provides for a forum that is efficient, quick and inexpensive; hearings are conducted on zoom; you don’t have to leave your desk; right or wrong, you’ll find out quickly.  The collection staff at K&K are well trained to best guide you, from start to finish.  They will weed out the cases that should not be brought, they will advise you if you need to make peace with the customer rather than get into a formal dispute and they will guide you through the hearing process, saving the customer when possible, recommending a settlement when appropriate, and following through with the hearing and entry of judgment and collection. Note you will need local counsel to confirm arbitration awards if it goes that far.
