FUTURE SERVICES AND 3 DAY RIGHT TO CANCEL
**********************
Ken
On the Florida Attorney General Site it mentions “future services” and the right to the 3 day cancellation.
Is Monthly Monitoring Services considered “Future Services”.  I’m inclined to believe it is but I would appreciate your opinion.  We have taken the position of “Better Safe than Sorry”
Thank You

The 3 day right to cancel applies to consumer agreements in almost all situations, especially when the transaction takes place at the residence.  The monitoring contract with a term of several years is certainly an agreement to render services in the future.  All the Standard residential agreements come with the 3 day cancellation notice and cancellation form.

home automation - nationwide agreement and license issues

I am having some of my team review the Nationwide DYI agreement for security equipment and I am waiting on their feedback. One thing I noticed is that while it covers alarm installation.  I didn’t see anything regarding automation installation (i.e. lighting controls, thermostats, etc.). Shouldn’t we want to address these items since different states may have different regulations regarding self installation?
Kindest Regards,
Grant

The nationwide form, which you purchased, comes with a consultation and revision.  We can make any changes you want but I suggest you take some time to review so that you can send all the requests at the same time [to avoid additional charges].  You purchased the DIY Security System agreement.  We can modify that agreement to include Home Automation items.
However, we also have a nationwide DIY Home Automation and Integration agreement, which does not include security equipment or systems.  That is offered as a separate agreement.  It also only works as a DIY system.  If you do installation I think you'll need separate contracts for each state, as well as licenses.
Note that if you contract for monitoring security systems you should have licenses.  Our licensing department can assist with that; contact Nicoletta Lakatos,Esq., at 516 747 6700 x 311 or NLakatos@KirschenbaumEsq.com  For the nationwide agreements contact our Contract Administrator Eileen Wagda at 516 747 6700 x 312 oe EWagda@Kirschenbaumesq.com
