Question re fire alarm inspections and liability
*************************
Ken
Yet another question about Fire Inspections and liabilities. Babylon Town, Suffolk County, NY
fire inspection forms only require that 25% of heat sensors be inspected.  What would the alarm companies' liability be if there was a fire and one of the other 75% of  heat sensors malfunctioned? Should we just play it safe and inspect 100%?
Thank you.

Great question.  What is you duty when performing a fire alarm inspection, the code or your contract or both?  Certainly the code sets the minimum standard for the inspection.  You would have to meet this minimum standard if your contract called for inspection per code, or if your inspection obligation isn't clear enough to create any other standard.  This actually is a serious issue because the Fire All in One includes inspection.  The provision requires an inspection of the equipment, and that would not be limited to minimum code requirements.  I think I am going to revise the Fire All in One and call for an option for 1) inspection to code or 2) full inspection.
What do you think?  Is this change necessary or desirable?  This change may also need to be made in the Residential and Commercial All in One contracts.

Question re conduct by Protect America
*****************************
Ken,
We are having a problem with a company called Protect America. They are calling customers and saying they are past employees of our company and have branched out on their own. They are offering discount prices if they switch.
My question is, are they doing anything illegal by trying to use  our name to gain access to our customer?  If you print this please keep it

I've already complained to the state agencies about this practice and I've written to the main company.  No response as of yet.  Of course the practice is improper and smacks of tortious interference of contract.

Yes.  In fact I am happy to announce that we have added a recently admitted attorney here in NY who is also recently admitted in Ontario Canada.  Her first assignment was to update the Canadian contracts.  So they are hot off the press.
