    We are a central station and I have a dealer who wants to include the contract language you have provided to us for our subscriber agreement on an "I agree" submit button.  Would putting on the exact terminology you have provided to us be sufficient?  Or since it's a web submit is there additional language I would need.

    Hard to comment since I don't know what terms you want to adopt or how you intend to do that, but no special manner of accent is needed because the agreement is on line.  Be sure that you have sufficient check points throughout the agreement and a final approval to clearly establish consent to the entire agreement, or use the docusign companies that capture signatures on line.

    Can you give me some insight into when to use the lien process for customers who are trying to get out of contract?  I know typically this would occur after a customer has been delinquent on payments for a period of time, but what if a customer is threatening to take down their equipment today?  Is there any way to deter them from doing so?  I appreciate your help!

    There are two liens, mechanics lien and UCC security interest.  For a mechanics lien you have to be improving real property and not all alarm and security systems meet that criteria.  That is also a complicated procedure to file and even more complicated and costly to foreclose.  The UCC is authorized in the Standard Form Agreements and permits you to file a security interest in certain equipment and property.  The filing is done on line and there is a nominal filing charge.  But the effect of filing will not stop "taking down the equipment"; it will cloud title so that your security interest, your lien, is known and you will eventually have the right to the liened property.  There are many articles on our web site discussing the lien remedy and rights.  Go to our articles page at  https://www.kirschenbaumesq.com/page/alarm-articles and use your edit feature, search and find, putting in UCC or mechanic lien to read the articles.

COMMENT ON SINGLE PANEL FOR BURG AND FIRE

    I appreciate your response. I will definitely double check the actual part number. However it looks like the other company used a burg panel without the secondary dialer and a red keypad 6160cr. Also, the other company didn't leave any annual test reports or tag the panel. I am definitely taking Ken's recommendation and having them sign the correct agreement and recommending that they get a commercial fire alarm panel installed according to NFPA 72.
