What are the negative ramifications for a customer that uses a non-licensed alarm installer in the state of New York.  I was on an estimate the other day and I got into a conversation with a prospective client about the importance of using a licensed alarm company such as mine.  She said that she had done some Internet research on the topic of licensed alarm installers in the State of New York and decided to call only licensed companies as she would assume that they are more qualified to do the job but nowhere could she find what the negative ramifications for the client would be that used a non-licensed installer.  She saw the penalties for the alarm company but again nothing about the client.  Honestly after all of these years in the business I couldn't definitively answer her question other then speculation about insurance coverage, etc.

So I ask you - What are the negative ramifications for a customer that uses a non-licensed alarm installer in the State of New York.

    The issue isn't limited to New York; it's a great question for all licensed jurisdictions, which is most states.  Considering all of the requirements for getting an Alarm Installer License in New York I'm surprised you couldn't come up with a few quick responses.  So why would a customer care if the alarm dealer was licensed?  Maybe price is all the customer should care about, or a suave sales pitch, or immediate installation, a fancy advertisement, or reputation or just a recommendation from a friend.  Well I can think of a few responses, and I'm sure there are many more.

  • Licensing laws generally include some level of competency requirements; 
  • Education and testing; maybe continued education or certification levels.  The license insures at least some level of competence. 
  • Criminal background check for all employees who will have any contact with the customer. Customers don't do their own background checks and this may be the single most important response you could offer.
  • Some jurisdictions require licensed dealers to maintain certain minimum standards of operation, such as contracts, insurance and standards.
  • Most jurisdictions will receive and act upon complaints made against licensed contracts, a remedy that may not be available if the customer chooses to deal with an unlicensed contractor.  
  • A licensed dealer has demonstrated that at a minimum he is willing to abide and conform to the licensing laws. Those that choose to disobey the licensing law may be ignoring lots of other laws that are designed to protect consumers.

    You may want to ask a few questions of your own when confronted with a customer who is making you bid against a non licensed contractor.  [and let's face it, you may have some difficulty competing with an unlicensed contractor - why?  because the unlicensed contractor doesn't have your expenses for license compliance, insurance, employee wages; might even get his equipment at Midnight Alarm Supplies or off a truck].  So ask, would the customer allow his or her kids to be picked up by a school bus employing driver's without driver's licenses or vehicle insurance?  No?  Then why would they allow someone unlicensed into their home and trust them with their security and safety?

Re: Med. office room status system & inspector:

I think Rob gave the answer to this issue himself. If there is no local requirement for the items to be listed & are not presented or called out as required 'Life Safety' features for the premise then Rob may have to do battle on this one with the AHJ.

Rob would be best advised to take it up a notch & talk to the inspectors boss & make his case. It would appear to me that he has a good case to fight this one if these requirements are not on the local books.

In response to Rob the Florida contractor and his question about code. If the assembly is not a fully listed assembly by a registered listing agency then it has to be approved before installation. In our jurisdiction we can sometimes take items to the local AHJ and see what they will allow. But if the inspector is applying the code articles you stated then you are in violation of that code. You are to install the system according to the installation instructions and listing and labeling. If the system is not listed and labeled then you can not install it. Just like you wouldn't allow a subcontractor to install something that will possibly make you liable the AHJ doesn't want to sign off on something that may make them or their jurisdiction liable. There will be more issues coming up soon with installations once nfpa 730 is absorbed into the code and local AHJ's start to apply it.

All electrical equipment MUST BE Listed for the purpose and approved by a Nationally Recognized Testing Laboratory. Is the Drs office a classified (hazard) location? Gases, oxygen, nitrous oxide etc? If so the equipment may have to be LISTED EXPLOSION PROOF or at the least INTRINSICALLY SAFE. (Normal operation will not be a hazard due to arcing etc).

If the Drs office is low or ordinary hazard was the equipment installed in boxes above the ceiling? Were splices in a box or loose. Were the conductors laying on top of the ceiling grid? Were there wall penetrations affecting the smoke integrity of the wall? Was the ceiling an air return plenum? (Requiring listed PLENUM WIRE).

That is one thing that a lot of alarm people fail to realize is that our craft is governed  By the NATIONAL ELECTRICAL CODE as well as others. Just because it is low voltage does not mean the code does not apply.NFPA  70 is defined as PROMOTING THE SAFE USE OF ELECTRICITY. A threshold voltage is not mentioned.

This case shows that if you don't take the time to DO IT RIGHT when can you find the time to do it again for nothing?  Pay attention to the LEVEL 1 NTS Certification course. Everything you may have done improperly is covered in this three day course.

The NEC defines the AHJ as being responsible for approving materials.  See article 100 of the NEC, definition of authority having jurisdiction and the word approved.

The sections quoted on the red tag are not the most relevant ones in this case, based on the contractors information.  The section that really applies here is 110.2 ..."equipment required or permitted by this code shall be acceptable only if approved."

It is a common practice of many AHJ's to require all equipment to be NRTL listed to be 'approved'.  This can be tricky if no one makes an approved part, then you have to get it listed, or get an exception by the AHJ.   Also, local amendments can change this completely.  You must investigate and find out if there are any that apply to your specific situation.

My previous experience has been similar.  You get stuck with an unmovable inspector and no way out.  I had a 50/50 success rate withe the following plan:  ask to respectfully meet with the inspector (maybe at his office) and show him that NO systems of this type are UL listed and never have been.  The 2nd stage worked once and failed once.  After he said no, I arranged a meeting with the Inspector's supervisor in his office and presented my case.  Verdict:  once it worked and once it failed.

If you work in a small town, and have to see this inspector again, even winning this case may cause you pain in the future.  If you are in a bigger city, go for it.
