Question:

Jennifer,

I am new to being an employer.  Do you have any tips to share?

Thank you,
Dr. K

Answer:

Well, there is an exhaustive list I could rattle off for new employers, but no particular item would be more important than the existence and availability of EPLI (Employment Practices Liability Insurance).  EPLI covers your practice for potential claims brought by employees that are not covered by Directors and Officers insurance or Comprehensive General Liability insurance - specifically, wrongful termination claims, discrimination claims (race, color, national origin, gender, sexual orientation, age, religion, pregnancy, etc.), sexual harassment, whistleblower claims, wage and hour claims, and other employment-related claims.

Many employers do not understand or identify a need for EPLI until it is too late and an employee has brought a claim.  Of course, by the time a claim has been brought it is too late to obtain coverage for that claim.
