More on Audio Interception and Recording

February 19, 2013

The issue of recording conversations beyond state lines was addressed in the February 8, 2013 article.  Knowing whether you are in a one or all party state is the first start when advising your subscribers, or establishing a working policy for your dealer or central station operation, about audio interception and recording.  You can read the statute in your state at https://www.kirschenbaumesq.com/page/alarm-law-issues

Below is a handy resource tool for a quick study on the issue.  Make sure your contracts provide for the subscriber's consent to recording conversations.  Also, your Employment Contract should provide for your employees' consent.

Mr. Kirschenbaum,

Very much appreciated your newsletter today on state audio monitoring statutes.

I’ve attached a copy of a resource many of our customers find valuable, a state by state guide to statutes and whether states are 1 or all party consent.  Many multi-state alarm companies also find this as a valuable reference tool when working across state lines.

Best Regards,
