Question:
Dear Jennifer,

An employee of mine wants to modify her agreement to change her schedule at our current practice. What is the best approach in going forward with this? Do we need to draft a whole new agreement?

Answer:
Typically with a day or schedule shift, I would not require a contract change unless a trigger in change of status is happening (part time to full time) and benefits may also be changing, or compensation structure.  That being said, there are always exceptions and perhaps you or your employee are more particular and wish to maintain a contract that explicitly matches your arrangement, in which case, yes, we can modify.   Also, it is important to always check back to your original contact form.  Does the original agreement require amendment in writing for any change, including schedule changes? If so, you may wish to honor the terms of the agreement and enter into an official modification.  If, perhaps, you wish for the modification to relax the language a bit, so, perhaps, day changes may be handled via email, mutually agreed to by both parties on a go-forward basis, we can make that change as well...
