    Can you clarify the rules in terms of hiring security technicians (or any employees for that matter) with felonies in NYS.  I can find the rules that stipulate that the alarm license holder can't have a felony but I can't find anywhere it states an employee can't have a felony.  Is there a way a person with a felony can appeal that rule?  I have neglected to hire people with felonies.  I'd like to start giving them a resource to overcome that if possible.  Some of them are good people who did something stupid a very long time ago.

    Hiring a felon in NY is not that much different than elsewhere.  In NY a licensed alarm company must "document" its employee within 24 hours of hiring that employee.  The documentation process includes sending the Division of Licensing Services the employee's finger prints and Employee Statement, where it will be revealed that the employee has a felony conviction.  The felony conviction will automatically disqualify the employee and you will get notice from DLS that you must terminate the employee at once.  The employee can challenge the dismissal by sending DLS a Certificate of Relief [which should have been provided when the Employee Statement was filed, or as soon as it is obtained].  DLS still has discretion to deny employment but will have to justifiy that decision.  With the Certificate of Relief the employee will more than likely not be disqualified, which means you will be able to continue employing the employee.

    I know you have answered this many times but it never pertained to me but now I need to know.  I sub contract for a company who does not use any alarm contracts.  I service and occasionally install alarm for them.  They are primarily a camera company.  I have given them a copy of my company contract (your contract) and told them to cover there a**es and buy one.  They have decided contracts are not for them.  I understand the importance and the liabilties of not using a contract.  Bad for them..........but how am I protected?  I understandably do not have a contract with their customer and they dont have a contract with their customer.  Am I a sitting goose??

    Yes and did you know a goose can stick its head up its own .....    So if the subscriber doesn't end up suing you I might for giving the camera company my contract.  I guess they won't bother stealing it because they don't need contracts.  
    If you are in the alarm - security business you need to use contracts with your end users.  If you are a subcontractor, so that you never have your own contract with the end user, you must determine that the alarm company that contracted with the end user does in fact have a contract, a properly worded contract with protective provisions, and a contract that extends its protection to subcontractors.  Without this you are exposed to liability that you could have easily avoided.  Also as a subcontractor you should have a written subcontract agreement between you and the alarm company or contractor hiring you to install the alarm system
