COMMENT ON CUSTOMER REQUESTS CANCELLATION (FROM NOVEMBER 13, 2015 ARTICLE)
***************
Ken,
On the same subject [customer requests cancellation] I have a subscriber that has an agreement with us to monitor their system;  they have one year left on the agreement. The wife signed the agreement.  The husband is in the military so he did not sign.  They now are divorcing and she is unwilling to pay for the services since she left the house.  The husband has been paying for the services and now she wants to cancel the agreement. What are my options?
Thanks
John

Husband didn't sign and therefore has no liability.  Also, he is in the military and if on active duty is protected by the Servicemembers Civil Relief Act, which excuses all payments and interest while on active duty and suspends any debts incurred prior to military service.  If he is back and wants to continue paying for the services going forward, have him sign a proper contract, whether it's for the remaining year or for a new five year term.  If he is still active or unwilling to sign a new agreement, best not to continue charging him.  The wife remains on the hook even though she moved, but she sounds like way more trouble then this will be worth.  If this is the case I suggest you terminate service and forget about it.

CAMERA IN PRIVATE PLACE
***********
Ken,
I have been contacted by a very close customer of mine for 25 years to install cameras in their 80 year old mother’s home. She is in the early stages of dementia and they have part time care coming to the house to keep an eye on her. One of her daughters does still live at home. I walked through the home with the daughter and she wants cameras around the perimeter of the house as well as some interior cameras including her mother`s bedroom and bathroom (which are quite large). Is it legal to install a camera in either of these rooms?  They will not be hidden cameras. They will be standard dome type cameras installed on the ceiling. They want to make sure she is not abused in any way by the nurse. Thank you for your time.
PS: We have been using your contracts for quite a while.
Best regards,
David

You can install the cameras.  Just get the consent from daughter and mom if possible.  Though bedrooms and bathrooms are generally off limits, the home owner can consent to the installation.  In your circumstances, especially since the cameras are not going to be covert, I think you can do the installation.  Be sure to use the Residential All in One and the Disclaimer Notice.  Also include in your proposal or Schedule of Equipment and Services that subscriber specifically asked for the camera placement in the bedroom and bathroom and the stated reason.
