From what I'm gathering the amendment is recommended as opposed to a strikethrough on the original agreement. We have a new salesman who is upselling, and I'm getting a lot of current agreements that need to be resent/amended. I'm looking for the best practice to accomplish that. Any direction or thoughts on agreement changes would be appreciated. Thank you for your time. Marie ************************ Response ************************ This is a common issue and it’s best that you have a standard consistent way to deal with it. Your question however raises several potential scenarios, each of which should be handled differently. Amending the All in One: There is no reason you can’t negotiate and agree to change some of the provisions in the All in One Agreements. While some provisions are strictly business judgment calls [such as whether you offer weekend repair service; or the term of the agreement] many of the provisions are “legal” in nature and written specifically to comply with one or more laws; you should be leery about modifying these provisions without assistance of counsel. Adding additional equipment or services during installation or shortly thereafter: When you purchased the Commercial Security All in One agreement or the Residential All in One agreement, we also provided you with a Supplemental Agreement. You can use this form to add additional equipment or services. The form will refer to the original agreement and provide for the new equipment and services, the cost of installation and the increase, or decrease as the case may be, in RMR. Upgrading existing system: When upgrading an existing system you should be using a new updated All in One agreement form. This is essentially a new contractual relationship; you start with a new full term agreement. Let’s say it’s a residential system and you are updating the communication device from 3G to 4G, or adding a smoke detector, or wiring an extension to the house, or adding wireless devices or replacing the most of the hard-wired devices.
