QUESTION: FIRE ALARM AGREEMENT

        We had a subscriber for several years, after our contract expired they switched vendors, then switched again.  Last week the new building manager called asking if we had the plans for the system, I said no and gave her some history, and she asked me to look at the panel to see what I think and give them an estimate.  I went last week, and there are a multitude of problems. 
        I gave them an estimate today based on repairing the fire alarm panel only, add another data loop for future expansion and to lighten the load on the existing loop.  The price was a not to exceed price, I really didn't think they would go for it, but they did.
        Part of the estimate spelled out the labor rate and that it was at a higher rate because they were no longer under an inspection, testing and per call service contract.  They want to go forward with the repair and also sign a new inspection contract with us.
        After the panel is repaired we know and the building manager knows there are other problems with devices and wiring in the field, additional repairs are needed.
        What is the best way to write the contract since we have a multi phase job plus the inspection and testing contract?

    The Fire All in One is perfect for your situation with this subscriber.  Why?  The subscriber is only contracting for immediate installation and repairs on T&M basis, and inspection.  The Fire All in One covers that.  You will detail the T&M sale and repairs in the Schedule of Equipment and Services, or your proposal which you will attach to the Fire All in One.  The subscriber will see the admonishment that the fire alarm must meet AHJ requirements and that the subscriber assumes all risk for non compliance.  The contract reminds the subscriber that you have advised and recommended a compliant fire alarm system.  
    The Fire All in One has all of the fire related services you might offer or provide to a commercial subscriber, such as design, installation, service, inspection and other features that encourage RMR.

QUESTION: CANCELLATION NOTICE TO EXISTING SUBSCRIBER

    We love your newsletter and have been using them for the last 2.5 years since we started our security business.  We are now to the point where we are getting ready to have customers that had 3 year contracts sign new contracts for our service.  We were wondering if we have to give the customer another 3 day Notice of Cancellation form, or if this is not needed since they already have our services and our system?

    Whether the subscriber is an existing customer or not is not the issue; the question is where was this new contract signed.  If at the residence then I suggest you give another 3 day notice of cancellation.  If the new contract merely corrects the existing contract then no notice would be required, but that's not likely the case.

QUESTION:  INSURANCE CARRIER TOO RISKY?

     We use SARRG but recently our broker has expressed concern about placing E & O coverage with a risk retention group.  I don’t really want to make a change but don’t want additional risk either.  Can you shed some light on this for me?

    SARRG is a risk retention group consisting of alarm industry companies.  It also carries excess coverage.  While there is a theoretical chance that the carrier and excess carrier will run out of coverage the possibility is so remote I consider it non existent.  There would have to be multiple catastrophic losses that the alarm companies were held responsible for.  Hasn't happened yet.  The reasonable premium and the expert claim handling makes this E&O carrier first choice.
