Subscriber fails to pay the RMR. We send a 10 day letter of cancellation.
Response A
subscriber pays up within the 10-days period.
Question? Is the contract still valid or have we in sending the cancellation letter negated it?
Response B
subscriber still does not pay. Outside forces (Fire Marshal) intervenes and subscriber then DOES pay. Again, same question – is our contract now still valid or do we need to get new contract signed (probably impossible situation as the ‘trust’ factor has been broken.

First of all your right to terminate a subscriber may be governed by the terms of your contract. The Standard Forms permit termination for non payment and no notice is required, though it's recommended.
In your examples you have created your own problem by sending a Letter of Cancellation. That by definition means you sent a letter that terminated the agreement and your performance. That letter should not have contained any option for payment. If you want to send a default letter with option to cure that is permitted and should be clear. Don't mix up the default notice with option to cure and the termination or cancellation notice which needs to be unequivocable in its terms. Termination letter should state the date and time that service will end and you should adhere to that time. If you continue providing service, monitoring or other service after that date you may not have the protection of your contract.
If you do send a notice of termination or cancellation and you then want to accept payment you must get a new contract or a written document signed by you and the subscriber reinstating the terminated contract. Anything else is going to create confusion and the possibility that your contract is not going to be enforced because it terminated.

Maybe Mike and Stu should leave the prevailing wage work to the union contractors. And also for their information it does not have to be a public project to be union / prevailing wage. It can be a mall or high rise building with a building trades agreement or it can be a totally private job with state or federal subsidized funding or loans etc. Leave the big jobs to the big boys. As you better be prepared to sign a 40 page AIA contract. Waive your rights for everything and wait 60 days to get paid. Don't even think of showing anyone you silly alarm contract thinking anyone would sign it limiting your liability. And don't forget your 10 mil umbrella policy. Hold harmless agreement. Waivers. Having to pay your vendors before you are paid etc
