There are several aid packages available and most businesses, alarm industry included, have or intend to take advantage of the government money, and they should. The funds are to assist employers and employees. As many of you have found out, applying for and getting the loan or grant proceeds has been fairly streamlined and straight forward. So what’s the issue? We can look to the past for guidance. In 2009 Congress passed stimulus bills to respond to the financial conditions. The stimulus package was not even half what is being funded for the Coronavirus stimulus. Yet, after the 2009 crisis subsided 4000 False Claims Act [FCA] complaints were filed. The government recovered over $23 billion from its FCA investigations, audits and prosecutions. The possibility of making an implied false claim means that a recipient of federal funds must know not only that the facts they communicate are true, but also that they meet any and all material program requirements. In the past when an agency issues vague guidelines the failure to comply with those guidelines excused a FCA claim. We don’t, however, know if the current administration, or future administration, will apply that precedent. If you receive federal funds the prudent practice would be to ensure compliance with agency guidelines. Reckless practices can result in FCA claims. After funding you should be careful to monitor compliance and operate strict quality controls.
